Probates are court supervised proceedings that take care of an individual’s estate after they have passed away if they have not planned otherwise. These are complicated and lengthy processes that are generally required to properly pass assets not otherwise taken care of.

Trust Administration is the process used when the decedent passed away with a valid trust. The Trustee is to administer the trust and estate plan according to the terms of the trust and as provided by the probate code. Typically, trust administration is done outside and does not include the court. There are notices and required acts of the trustee that must be followed to properly complete the trustee’s fiduciary duties and close the trust.

Depending on the value of the decedent’s estate and the estate plan they had at the time of death, the process may involve an Affidavit, a Declaration for Small Estate, a simple probate, a formal probate, or trust administration.
